Terms of Service

1. Service Description and Scope

Fix47 provides web accessibility remediation services designed to bring your website into conformance with WCAG 2.2 Level AA. Our services include the following testing layers:

  • Automated WCAG scanning — axe-core (90+ rules, ~57% of WCAG 2.2 AA criteria)
  • Keyboard navigation testing — automated Tab/focus/trap testing (WCAG SC 2.1.1, 2.1.2, 2.4.3, 2.4.7)
  • Screen reader testing — VoiceOver via automated runner (WCAG SC 1.3.1, 4.1.2, 4.1.3)
  • Critical user flow testing — keyboard + screen reader testing of agreed flows
  • Human expert review — manual assessment of criteria automated tools cannot evaluate
  • Remediation, verification, and Audit Certificate

Estimated WCAG 2.2 AA coverage: approximately 85–93% of testable Level AA success criteria. This does not represent a guarantee of 100% conformance. See Section 4.2 for what is not covered.

1.2 Explicit Scope Exclusions

The following are excluded from all Fix47 services unless separately agreed in writing:

  • Third-party widgets, iframes, payment processors, chat plugins, social embeds
  • PDFs, Word documents, and downloadable files
  • Video captions, audio descriptions, sign language interpretation
  • CAPTCHA accessibility
  • WCAG 2.2 Level AAA criteria
  • Native mobile applications (iOS/Android)
  • Content added to the website after the delivery date
  • Pages and templates outside the agreed remediation scope
  • Ongoing compliance monitoring (Shield Monitor — available separately at $297/month; 1-click cancel via Stripe portal)

2. Not Legal Advice

Fix47 is not a law firm, does not employ attorneys, and does not provide legal advice.

All risk estimates, legal exposure figures, lawsuit statistics, and case references are for general informational purposes only. They are generated using automated algorithms based on publicly available data and do not constitute legal counsel, legal opinions, or predictions of specific legal outcomes. Consult a qualified attorney for advice specific to your legal situation.

3. Acceptable Use

You agree to use our service only to scan websites you own or have authorization to scan. You agree not to:

  • Scan websites you do not own or are not authorized to scan
  • Attempt to overload, disrupt, or reverse-engineer our service
  • Use scan results to harass, threaten, or extort website owners
  • Resell or redistribute scan reports without written authorization

4. Performance Guarantees

4.1 Five-Business-Day Delivery Guarantee

Fix47 will deliver remediation work within 5 business days from the date project access is granted (meaning: FTP credentials, CMS login, or repository access has been received and confirmed). If Fix47 misses this deadline due to Fix47's fault — excluding delays caused by client unresponsiveness, third-party system dependencies outside Fix47's control, or scope changes requested after project start — you may request a full refund within 30 days of the missed deadline. Refunds are processed via Stripe within 7 business days of the approved request.

4.2 90-Day Re-Remediation Guarantee

If any violation that Fix47 remediated and verified at delivery regresses within 90 days — meaning it reappears in the agreed scope through no action of the client — Fix47 will re-remediate it at zero additional cost. This covers violations within the pages, templates, and testing layers defined in your Audit Certificate.

Conditions: (i) written notice to carlo@fix47.com within 7 business days of discovering the regression; (ii) no client-initiated modifications to the remediated code after delivery; (iii) the regressed violation must be within pages and flows listed in the Audit Certificate; (iv) the violation must be within the testing layers described in Section 1.

This Guarantee DOES NOT COVER: legal fees, attorney fees, settlement amounts, court judgments, fines, penalties, or any monetary payments to third parties. Fix47 is not an insurance company and does not provide legal defense. This is a technical re-remediation commitment only.

4.3 The ADA Shield Guarantee

If you receive an ADA Title III demand letter while Fix47 actively manages your compliance (i.e., during your engagement period or active Shield Monitor subscription), Fix47 will:

  • (a) Re-scan your site against the violations cited in the demand letter;
  • (b) Provide technical re-remediation at zero additional cost if any technical violations within our agreed scope are found;
  • (c) Supply technical remediation documentation (Audit Certificate, VPAT template, remediation log) for your attorney's use.

Fix47 does NOT provide legal representation, legal advice, or legal defense. We do not appear in court, prepare legal pleadings, or represent you to plaintiff counsel. Our role is strictly technical remediation. Engaging Fix47 is not a substitute for retaining qualified ADA defense counsel.

Conditions: client must provide timely codebase access and respond within 48 hours; demand letter must relate to ADA Title III claims; applies only to violations within agreed scope and not caused by client modifications after delivery.

4.4 What Fix47 Does NOT Guarantee

  • 100% WCAG 2.2 AA conformance — Our audit covers ~85–93% of criteria. Approximately 10–20% require evaluation outside our standard scope
  • Immunity from ADA lawsuits or demand letters — ADA claims may allege barriers outside our audit scope
  • Ongoing compliance — Fix47 is not responsible for violations introduced by content or code changes after delivery
  • Specific legal outcomes — No guarantee regarding the outcome of any legal proceeding

5. Payment Terms

Current pricing (USD):

  • Founding Group 1 remediation: $1,297 (5 spots — founding cohort only)
  • Founding Group 2–4: $1,997 / $2,497 / $2,997 (sequential, as each group fills)
  • Full investment after founding closes: $4,997
  • Shield Monitor: $297/month or $891/quarter (default) or $2,997/year — 1-click cancel via Stripe portal

Payment is due 100% upfront before work commences. If Fix47 cannot complete the services, a full refund will be issued for unperformed work.

5a. Subscription Cancellation and Refunds

Shield Monitor subscriptions (monthly, quarterly, or annual): You may cancel at any time via the Stripe customer portal. No refunds are issued for the current billing period already paid; you retain full access to Shield Monitor until the end of that billing cycle.

One-time remediation engagements: Refunds are available as described in Section 4.1 (SLA breach) and Section 4.3 (ADA Shield) only, or where Fix47 cannot perform the services.

EU and UK consumer rights: consumers habitually resident in the EU or UK retain the 14-day right of withdrawal under the Consumer Rights Directive 2011/83/EU Art. 9 and the UK Consumer Contracts Regulations 2013, unless the service has commenced with your express consent and acknowledgement that the right of withdrawal is waived upon commencement. By proceeding with payment and providing site access, you acknowledge that service has commenced and consent to waiver of the 14-day withdrawal right. This does not affect other non-waivable statutory rights.

6a. No Warranties

EXCEPT AS EXPRESSLY STATED IN SECTION 4 (GUARANTEES) AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. FIX47 SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT (UCC §2-316(2)). NOTHING IN THIS SECTION LIMITS RIGHTS YOU HAVE UNDER UK CONSUMER RIGHTS ACT 2015, EU CONSUMER RIGHTS DIRECTIVE 2011/83, OR OTHER NON-WAIVABLE CONSUMER PROTECTIONS.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Fix47's total aggregate liability for all claims shall not exceed the total fees actually paid by you for the specific engagement giving rise to the claim (e.g., $1,297 Founding Group 1 / $4,997 full investment).

Fix47 shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to: loss of profits, business interruption, legal fees, settlement costs, fines, penalties, or any monetary payment to any third party — including ADA demand letter settlements, court judgments, or regulatory penalties.

For UK/EU clients: nothing in this section excludes Fix47's liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the UK Consumer Rights Act 2015 or EU Unfair Contract Terms Directive 93/13/EEC.

7. Data Protection

Fix47 processes personal data in accordance with the GDPR (EU) 2016/679, UK GDPR, and CCPA where applicable. Fix47 acts as a data processor on your behalf during the remediation engagement. Scan logs and audit data are retained for a minimum of 2 years from the date of Audit Certificate issuance.

For EU/UK clients, Fix47 will enter into a Data Processing Agreement (DPA) in accordance with GDPR Article 28 upon request.

8. Dispute Resolution and Governing Law

US clients: Disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or by JAMS at the election of either party. Seat of arbitration: London, England. Class action waiver applies. Either party may opt out of arbitration within 30 days of accepting these Terms by written notice to carlo@fix47.com.

UK/EU clients: Disputes shall be resolved by arbitration administered by JAMS or the Chartered Institute of Arbitrators (CIArb). Seat of arbitration: London, England. Mandatory arbitration clauses do not apply to consumer claims where prohibited by applicable law.

Governing law: These Terms are governed by the laws of England and Wales, subject to mandatory consumer protection provisions of your country of habitual residence (Rome I Regulation 593/2008 Art. 6 where applicable).
